    If the gun did not belong to the passenger and the driver knew the gun was in the car and does not claim it. Who owns the car? If Ruiz owns the car, is the gun stolen?

    I don't think it really matters who owns the gun, he knew it was there. And I bet he was just holding the dope for "a friend".
