Idk if that means they have a near zero chance. They put it on hold.

The lower court actually had stated that OSU/WSU were reasonably entitled to spend some of this year's earnings (ballpark $400m?) on efforts to rebuild the conference. There is corporate law that supports this position.
The other schools who want to maximize their earnings naturally appealed. Just because the lower courts temporary injunction is on hold pending review doesn't mean it will be reversed.
Ultimately, PAC 2 will get control of the conference imo. The real question is how quickly, and how much of the earnings and assets do they get to retain. Second question is do they intend to fold the tent, or rebuild PAC?
A lot of indicators they would like to rebuild. If they succeed, and pull schools from AAC and MWC, there will be openings. And I believe we would be very well positioned for MWC. AAC would likely look elsewhere.

Yes, and in addition the PAC 2 overtures to AAC and SBC were rejected.
PAC 2 need a schedule just to exist. Scheduling FBS games is not optional to maintain FBS status.
MWC has to be concerned some of their best schools could be poached by PAC after the dust settles.
Given the leverage MWC has at the moment, and current income and assets PAC-2 are about to "inherit", $14m is actually a reasonable ask.
No G5 conference has ever asked something similar of a FCS school that joins.

Over the past year or so I've seen the PAC plan, want, and wish many things. None of them worked out. Pretty sure this won't either. That's not an agenda, it's an observation.

Bigger picture, what the “PAC” wanted was payouts matching the B1G and B12. A large number of the PAC member schools achieved that goal. The two left behind are collateral damage to the others achieving their goals.
I don’t think PAC is dead yet.

we’ve been engaged in aggressive and thorough outreach to the NDSU administration and despite set backs lawsuits and restraining orders we remain undeterred in our attempts to get them to join our beautiful strong illustrious conference
